The Energy Vibration (Pty) Ltd website at www.goodvibration.co.za and any agreement of sale between the customer and Energy Vibration (Pty) Ltd, as well as any services, tests or treatments provided by Energy Vibration (Pty) Ltd, are governed by the laws of the Republic of South Africa.

3.1     These terms and conditions (“Terms”) apply to your use of our website, our services and undergoing any tests or treatments of Energy Vibration (Pty) Ltd.

3.2     These Terms apply to users who are consumers for purposes of the Consumer Protection Act, 2008 (Act No. 68 of 2008) (the “CPA”).

3.3     By using this website or services or by undergoing any of our tests or treatments, you acknowledge that you have read and understood these Terms and agree to be bound by them.

3.4     These Terms represent our entire agreement with you and supersede all prior terms, conditions, warranties or representations to the extent permitted by law.

3.5     You are not authorised to use this website or our services or to undergo any of our tests or treatments if you do not agree to be bound by these Terms.

3.6     These Terms may be updated or changed from time to time, without prior notice to you.  It is your responsibility as user of our website or services to check our Terms regularly, as you acknowledge, through your continued use of our website or website or services or by undergoing any of our tests or treatments that you accept to be bound by any updated or revised Terms.

4.1     This website may be used by customers to browse the content, services, tests, treatments and products and to make legitimate purchases.

4.2     By using our website, you hereby indemnify Energy Vibration (Pty) Ltd against any loss, damage, harm, claim or any other cost whatsoever that we may sustain as a result of your use of our website or its contents, our services or by undergoing any of our tests or treatments contrary to the Terms.

4.3     You hereby grant Energy Vibration (Pty) Ltd consent to use cookies to identify the computer device with which you connect to our website.

4.4     Energy Vibration (Pty) Ltd reserves the right to restrict your use and access to our website or part thereof in the event of any unauthorised use. We likewise reserve the right to request identification from you when using our services or undergoing any of our tests or treatments or returning products.

4.5     Energy Vibration (Pty) Ltd reserves the right to refuse service to you, to suspend our website or any part thereof or terminate your account at any time if we, in our sole discretion, determine that you are not shopping or using our website in compliance with the Terms or if we believe the information provided by you is untrue, inaccurate, or incomplete.

4.6     Any indulgence of extension of time granted to you must not be construed as a waiver or variation of any of our rights or remedies in these Terms or in law.

 

  1. DESCRIPTION OF GOODS & SERVICES
    • Energy Vibration (Pty) Ltd is an online business to consumer outlet that sells organic and natural products and provides tests and treatments that strive to improve the quality of human life through the identification and treatment of health risks. We specialise in the provision of Herbal Supplements (i.e. products derived from plants or their oils, roots, seeds, berries or flowers) and Frequency Therapy (i.e. non-invasive treatment aimed at restoring the balance in your body and mind through the application of specific vibrations).
    • We do not warrant or guarantee that the results that may be obtained from the use of our products or services will be accurate or reliable.

 

  1. USE OF CONTENT, IMAGES OR PRODUCTS
    • The unauthorised use, reproduction, modification or distribution of our content, images or products is strictly prohibited and constitutes an infringement of our intellectual property rights.
    • You are not authorised to use our content, images or products as they appear on our website, without prior written consent.

 

 

  1. AVAILABILITY AND PRICING OF PRODUCTS

7.1     The products, services and treatments displayed on our website are priced in South African Rands, are subject to availability and are valid and effective only in the Republic of South Africa.

7.2     Energy Vibration (Pty) Ltd reserves the right to discontinue or change the specifications of our products, services, tests or treatments from time to time without notice and will inform you as soon as possible if any products or services ordered by you are not available.

7.3     Prices displayed on the website include Value-Added Tax (“VAT”).

7.4     Energy Vibration (Pty) Ltd reserves the right to change the pricing, or to limit the quantity, of any item offered for sale online at any time, without notice to you.

7.5     If it becomes known after an order has been placed that there are unforeseen stock shortages, Energy Vibration (Pty) Ltd reserves the right to amend your order or to replace it with available stock and credit or refund the applicable difference to you, which will be communicated to you.

7.6     Energy Vibration (Pty) Ltd will charge a delivery fee for each order placed by you, which will be indicated as a separate item on the proof of purchase.

7.7     In the event of an obvious pricing errors in the displayed price, Energy Vibration (Pty) Ltd will take steps to correct the error in the displayed price and take reasonable steps in the circumstances to inform you of the error and the correct price.

 

  1. AGREEMENT OF SALE

8.1     All products remain the property of Energy Vibration (Pty) Ltd until payment has been made in full. The agreement of sale between the customer and Energy Vibration (Pty) Ltd is only valid once payment has been received and cleared in Energy Vibration (Pty) Ltd’s bank account.

8.2     Energy Vibration (Pty) Ltd will take responsibility for all transactions on this
website – sales, service, support, dispute resolution and delivery of goods.

 

  1. PAYMENT OPTIONS

9.1     Payments for products or services can be made online by debit or credit card, using the integrated secure Walletdoc payment gateway on checkout.

9.2     Transactions on our website are processed in South African Rand (ZAR).

9.3     By placing orders and making payments on our website, you warrant that you are over the age of 18 (eighteen), that you are authorised to make payment with the chosen payment method and that there are sufficient funds available to pay for the order.

  1. DELIVERY POLICY
    • We will endeavour to process all orders within 2 (two) working days.
    • Orders are dispatched via various courier services. Delivery takes between 7 (seven) and 14 (fourteen) working days, depending on the courier service used.  Delayed delivery does not constitute a ground for a return or refund of products.
    • The respective courier services will confirm proof of delivery. The acceptance and signature of the products by any person at the delivery address is regarded as confirmation of the delivery of the products.
    • Energy Vibration (Pty) Ltd accordingly cannot, to the extent permitted by law, be liable for any damage suffered or loss incurred by reason of any acts or omissions of the courier services, its directors, employees, sub- contractors, agents, representatives or affiliates.

 

  1. RETURN & REFUNDS POLICY
  • Energy Vibration (Pty) Ltd will accept an order cancellation up to the point before the order has been dispatched and collected by the respective courier service.
  • If you are not happy with a product that you received for any reason or the wrong product has been delivered to you, please contact us within 7 (seven) days of receipt of the product with the reason for dissatisfaction. If the product is still in its sealed state, we will issue a return order that serves as authorisation for your return of the product to us.

11.3  Shipping or courier costs for the return of any products are for your own account. 

11.4   Upon receipt of the product we will inspect the item and, if it is still in its original sealed state, will then refund you the full value of the product. Refunds are bank dependent and may take between to 10 (ten) and 14 (fourteen) working days to reflect.

11.5   Energy Vibration (Pty) Ltd will not refund any product of which the seal has been opened, broken or tampered with or any products of a personal nature due to hygiene and sanitary considerations.

11.6   Late delivery or the non-achievement of the desired results after having used any of our products will not be grounds for a return or refund.

12.1   Our products are not intended to diagnose, treat, cure or prevent any disease.

12.2   Energy Vibration (Pty) Ltd takes all reasonable measures to ensure that information regarding our products are accurate and correct and that our products are safe to use, and of good quality. Despite this, we do not accept any responsibility for the accuracy or completeness of information provided on the website, and we do not accept responsibility for any adverse reactions that any of the products may cause.
